Welcome to Fixing House Ltd (“we,” “our,” “us”), the platform designed to connect homeowners with qualified tradespersons for repair and maintenance needs (“Fixing House App”). By accessing or using our services, you (“user,” “you,” or “your”) agree to comply with these Terms and Conditions. Please read them carefully before using the platform.
1. Acceptance of Terms
By accessing or using the Fixing House App, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these terms, you must not use the platform.
2. User Registration and Account
- To use the Fixing House App, homeowners must register an account. Tradespersons can access and register separately via Fixing House for Tradespersons app (not applicable here).
- You agree to provide accurate, complete, and up-to-date information when registering for the platform. You are responsible for maintaining the confidentiality of your account credentials.
- If you suspect unauthorized use of your account, you must notify us immediately.
3. Eligibility
- The Fixing House App is available to users in the UK only.
- You must be at least 18 years old to use the Fixing House App.
4. User Obligations
You agree to:
- Provide accurate and detailed descriptions of your repair needs, including relevant images where applicable.
- Not post any illegal, misleading, or offensive content.
- Act professionally and responsibly when using the platform.
- Not engage in fraudulent activity or abusive behavior.
- Verify the qualifications and insurance of tradespersons before hiring them.
5. Payment Terms
- Fixing House Ltd facilitates payments through Stripe, and users agree to make payments for services via the app only. Do not pay tradespersons directly by cash; all payments must be made through the platform.
- Payment can be made using credit/debit cards, Google Pay, Apple Pay, or Klarna. Fixing House Ltd will process payments immediately and send them to the tradesperson within 1-3 business days.
- If you attempt to pay a tradesperson outside of the platform, your account may be terminated.
6. Job Cancellation and Modifications
- Homeowners can cancel or modify their job posting freely until a tradesperson has been assigned. Once a tradesperson accepts, the job posting cannot be deleted but can still be modified.
- Homeowners must ensure the tradesperson visits the property. You may refuse a tradesperson’s visit without penalty, but you will not be charged until the job is completed to your satisfaction.
- If you cancel the job after the tradesperson has been assigned or completed the work, there will be no refund, as payments are only processed once the job is completed.
7. Job Quality and Disputes
- Fixing House Ltd is not responsible for the quality of work performed by tradespersons. Homeowners must check the tradesperson’s qualifications and insurance before accepting any job offers.
- If you are dissatisfied with the work completed, we suggest negotiating directly with the tradesperson. Disputes over job quality should be resolved between you and the tradesperson.
- Fixing House Ltd does not mediate disputes but may investigate issues for future improvements. We encourage users to resolve disputes independently or seek legal action.
8. Insurance
- Homeowners must ensure that the tradesperson they hire has appropriate insurance to cover any potential damage or injury while performing the job.
- Fixing House Ltd is not responsible for any damage caused by the tradesperson, and homeowners should verify the tradesperson’s insurance before allowing them to start the job.
9. Termination of Account
- Fixing House Ltd reserves the right to suspend or terminate any account that violates these Terms and Conditions, including fraudulent activity, abuse, harassment, or posting illegal content.
- If you violate any terms, your account may be suspended or terminated without prior notice.
10. Intellectual Property
- All content posted by you on the platform, including images, job descriptions, and feedback, may be used by Fixing House Ltd for promotional and marketing purposes, including on social media and websites.
- By submitting content, you grant Fixing House Ltd a non-exclusive, royalty-free license to use, reproduce, and distribute your content for advertising and marketing purposes.
11. Limitation of Liability
- Fixing House Ltd is not responsible for any direct, indirect, or consequential damages arising from the use of the platform, including but not limited to property damage, personal injury, or financial loss.
- The platform does not guarantee the success or satisfaction of any job posted by homeowners or performed by tradespersons.
12. Dispute Resolution
- Any disputes between homeowners and tradespersons should be resolved directly. If an issue cannot be resolved, legal action may be taken through UK courts.
- Fixing House Ltd is not a party to any disputes and does not mediate between users.
13. Force Majeure
- Fixing House Ltd will not be held liable for any delay or failure to perform its obligations under these Terms and Conditions due to events beyond our reasonable control, including but not limited to acts of nature, war, strikes, or technical failures.
14. Modification of Terms
- Fixing House Ltd reserves the right to modify or update these Terms and Conditions at any time. Users will be notified of significant changes via email or in-app notifications. Continued use of the platform after such changes constitutes acceptance of the updated terms.
15. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the UK courts.
16. Data Privacy and Protection
- By using the Fixing House App, you consent to the collection and processing of your personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
- You have the right to access, correct, or delete your personal data at any time. Please refer to our Privacy Policy for further details.
17. No Cash Payments
- Fixing House Ltd strictly prohibits payments made outside of the platform. All payments for jobs must be processed through the app using the available payment methods (credit card, Google Pay, Apple Pay, or Klarna). If you make payments directly to a tradesperson, your account will be terminated.
